What data we receive when you write to us, what we use it for and how to exercise your rights.

Version 1.2 · effective October 23, 2026
Chile’s Law 19,628 on the protection of private life currently applies. Its amendment, Law 21,719, takes effect on December 1, 2026: when we say “amended law,” we cite Law 19,628 as amended by Law 21,719.
Who is responsible for your data
Mente Minera Consultora is a Chilean consultancy specializing in recruitment, behavioral safety and change management for mining. It is the name used by the company responsible for your data (the data controller):
- Legal name: Servicios Psicológicos Carolina Jeneral González E.I.R.L.
- Taxpayer ID (RUT): 76.978.249-4
- Address: Avenida Vicuña Mackenna 881, Santiago, Chile
- Legal representative: Carolina Jeneral González
Carolina Jeneral González, founder and director, handles personal data matters. Write to us at contacto@menteminera.cl.
What data we receive
Only what you give us, usually on behalf of a company:
- Through the contact form: name and title, company, work email, phone (optional) and your message. When you send it, the form service also logs your IP address.
- If you write to us by email or WhatsApp: whatever data you include in that message.
- When you visit the site: your IP address and technical connection data, logged by the hosting provider to serve the pages.
We do not ask for sensitive data, such as health data, and we ask you not to include it in your message. Only if you accept it in the cookie notice, the site uses Google Analytics, to measure visits, and Google Ads, to learn which ads bring us inquiries (see “Measurement cookies”). If you do not accept, it uses no cookies, analytics or ad tracking.
What we use it for, and on what basis
- To answer your inquiry and, where relevant, prepare a proposal.
- To protect the form from spam and abuse: the form service checks the IP address and email address of each submission with spam filters.
- To serve the site: the hosting provider processes each visitor’s IP address.
Today the basis is your consent: when you send the form, you check a box accepting these uses (Law 19,628, art. 4). From December 1, 2026, answering your inquiry is also a pre-contractual measure you request, and the spam filter and hosting rest on our legitimate interest in keeping the site and the contact channel working (amended law, arts. 12 and 13(c) and (d)).
Measurement rests on the consent you give in the cookie notice (see “Measurement cookies”).
We do not use your data to send you advertising, we do not sell or disclose the data you send us through the form to third parties for their own purposes, and we make no automated decisions about you. If the spam filter ever holds back your message by mistake, email us directly.
Who else is involved
These providers process data to deliver their services:
- Web3Forms (Web3Creative, India) receives the form and forwards it to us by email, as a processor under its data processing agreement. It runs on Amazon Web Services, Cloudflare and Hetzner infrastructure, and shares each submission’s IP address and email address with its spam filters (CleanTalk and Automattic, United States). Its agreement also lists Microsoft (Clarity), which analyzes use of its own dashboard.
- Vercel (Vercel Inc., United States) hosts the site and processes each visitor’s IP address, as a processor under its data processing agreement.
- DevZen SpA (Chile) develops and maintains the site and manages its hosting; it can see the technical visit logs.
- V2Networks (Chile) hosts our email, where we receive and keep your messages.
- Google (Google LLC, United States) provides Google Analytics and Google Ads, which the site loads only if you accept the measurement cookies. It receives the data described under “Measurement cookies” and handles it under its own terms and privacy policy.
If you write to us on WhatsApp or LinkedIn, those platforms handle your data under their own policies.
Data outside Chile
Web3Forms and its providers, Vercel and, if you accept the measurement cookies, Google process data outside Chile: in India, the United States, the European Union and other countries where they operate. Law 19,628 does not currently regulate these transfers. From December 1, 2026, the Personal Data Protection Agency will determine which countries offer an adequate level of protection (amended law, art. 28); that list does not exist yet.
As for safeguards, Web3Forms and Vercel process the data under processor agreements. Web3Forms’ agreement sets confidentiality and security duties, oversight of its sub-processors, notification of incidents within 72 hours and deletion of the data when the service ends. Neither includes the Chilean model contractual clauses or gives you enforceable rights against them, and for CleanTalk and Automattic there are no specific safeguards for data leaving Chile.
With Google there are no Chilean model contractual clauses either, nor rights you can enforce against it: if you do not want your browsing data to reach Google, simply do not accept the measurement cookies.
If you would rather not use the form, email us directly at contacto@menteminera.cl: our email is hosted by a Chilean provider.
How long we keep it
- Your message and contact details, for as long as the conversation or proposal lasts. If no engagement follows, we delete them from our mailbox no later than twelve months after the last contact.
- If an engagement follows, for as long as it lasts and for whatever period the law requires afterward.
- The form service keeps a copy of each submission, including your IP address, and deletes it automatically after three years: that is the maximum period. If you ask us to delete your data, we ask it to delete that copy sooner.
- Technical visit logs are kept for one day by the hosting provider, in addition to whatever Vercel keeps under its own privacy policy.
Your rights
You can request access to your data or its correction, deletion, blocking or portability; object to its processing; and withdraw your consent at any time, with no retroactive effect. Email us at contacto@menteminera.cl with your request and details we can use to identify you. There is no charge.
Law 19,628 currently applies: we reply within two business days, and if we do not, or we refuse your request, you can take the matter to a civil court (arts. 12 and 16).
From December 1, 2026, under the amended law, the deadline becomes 30 calendar days, extendable once by up to 30 more. While we resolve a request for correction, deletion or objection, you can ask for a temporary block on your data, which we answer within two business days, and you can file a complaint with the Personal Data Protection Agency (arts. 8 ter, 11 and 41).
How we protect it
- The whole site is served over HTTPS, and the form is sent encrypted.
- The site has no database of its own: your message reaches our mailbox by email, and the form service keeps its copy encrypted at rest on Amazon Web Services.
- From December 1, 2026, if a security breach creates a reasonable risk to your rights, we will report it to the Agency without undue delay and log it (amended law, art. 14 sexies). If it affects you, we will also let you know.
Changes to this policy
If we update it, we will publish the new version here with its date. The current one is version 1.2, dated October 23, 2026.
- Version 1.2 (October 23, 2026): we added Google Analytics and Google Ads measurement cookies, which the site uses only if you accept them in the cookie notice, and added Google to the providers involved.
- Version 1.1 (October 1, 2026): we added the legal details of the company responsible for your data (legal name, taxpayer ID, address and legal representative); this does not change what data we receive or what we use it for.
- Version 1.0 (September 30, 2026): initial version.
